WHITE MOUNTAINS RANCH PURCHASING CONTRACT
The Seller, _____________________, and the Buyer, ______________________, hereby agree as follows:
The Seller hereby sells to the Buyer, for the amount of $____________, payment of which is hereby acknowledged, a male/female Anatolian Shepherd puppy, born ________________, by ___________________________, out of _____________________, in accordance with the terms of this contract.
1. HEALTH
The Seller guarantees that the puppy is in good health on the date of delivery. The Buyer has the right to return the puppy to the Seller within three (3) days after delivery and receive a refund of the purchase price if the puppy is found by a veterinarian to be suffering from any disease, a copy of all veterinarian records shall be provided by buyer.
The Seller guarantees that the puppy is free of hereditary defects to the best of his/her knowledge. Should the puppy be diagnosed with hip dysplasia prior to its second birthday, or suffer loss of eyesight due to Progressive Retinal Atrophy (PRA), seller agrees to refund the purchase price. Buyer may keep the dog if he/she so desires, but must present certification by a veterinarian if the complaint is hip dysplasia, or by a veterinary ophthalmologist if the complaint is PRA or CEA. The Seller does not assume any additional liability for possible genetic defects in the puppy, and will under no circumstances be responsible for veterinary bills resulting from any such condition.
Buyer agrees to maintain this puppy/dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and - where indicated - heartworm preventative medication. Buyer further agrees to provide proper exercise as indicated in order to maintain this puppy/dog in proper weight and physical shape. A proper diet consists of top-quality puppy/dog food and supplements. The Buyer agrees to maintain preventative care of the puppy/dog in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (ie. not allowing the puppy/dog to jump from heights taller than itself at the shoulder, no forced exercise such as running, until at least 18 months of age.)
Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller.
2. TEMPERAMENT
Seller strongly recommends that Buyer attend obedience classes with puppy/dog and provide proper socialization opportunities for puppy/dog.
Seller shall not be held responsible for acts of puppy/dog which are due to Buyers negligence.
Buyer agrees that this puppy/dog is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY. This puppy/dog is sold with the understanding that it is to go to carefully selected parties and that Buyer AVOWED the puppy/dog would become a member of the family and/or to be maintained as a Livestock Guardian. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)
Should puppy/dog exhibit aggressive behavior which Buyer deems intolerable and irreversible within 12 months after purchase, Buyer will provide Seller with proof that puppy/dog has been sufficiently socialized and that obedience classes and other structured training methods have been attempted with no results. (Bite/Protection work will void this section of the contract). Upon receipt of such proof, evaluations of puppy/dog will be scheduled with two recognized Veterinarians, one to be chosen by Buyer and one to be chosen by Seller. Should puppy/dog be deemed overly aggressive by both of the chosen Veterinarians, Seller will arrange for euthanasia of puppy/dog and provide Buyer with a replacement puppy/dog as soon as such a puppy/dog is available.
3. REHOMING
In a perfect world we would like to have each puppy we place to stay in their original purchasing home. However, we understand things do happen, should you be unable to keep your puppy, you agree to contact White Mountains Ranch, in writing, phone or email and let us know BEFORE the puppy has been placed into a new home. We require a right of first return or reclamation- that the puppy be returned to us if you cannot keep him or her. You are not free to give the puppy away to another family member or anyone without receiving permission from us first. If the new home has been approved by the seller, this contract is still your responsibility to enforce in the puppy's new home.
4. REFUNDS/RETURNS:
If for any reason, the buyer is no longer able to care for the puppy, or no longer wishes to own it, we will take it back. There will be no refund.
5. BREEDING
If you purchased your puppy with breeding rights, the puppy shall not be bred unless it shall first (1) have been x-rayed and certified clear of hip dysplasia by OFA or other competent individual or organization, (2) have been certified clear of hereditary eye disease by a canine ophthalmologist, and (3) have displayed good livestock guarding ability. (4) Nor shall it be bred to a bitch or dog who does not meet these same conditions. (5) Dog Shall not be bred to any dog that is not also a purebred registered Anatolian Shepherd.
The Seller shall not sell the puppy, or its offspring (if any), to any individual or establishment in the business of buying and selling puppies for a profit.
6. DEATH
In the case of the puppy's demise after purchase within six months. a written statement from your veterinarian must be sent to White Mountains Ranch, stating that the puppy has indeed passed away, and the cause of death.
